Terms of Use

Japanese (authoritative version)

These Terms of Use (the "Terms") set out the conditions for using depico (the "Service"), an image editing service provided by poopootei (the "Operator"). Anyone who uses the Service (a "User") does so on the basis that they agree to these Terms.

Article 1 (Scope)

  1. These Terms apply to all relations between the Operator and Users concerning use of the Service.
  2. Any notices or guidelines separately posted by the Operator within the Service form part of these Terms.

Article 2 (Conditions of Use)

  1. The Service requires no account registration and is free of charge.
  2. Users are responsible for the devices and network connection required to use the Service, and for any costs these entail.
  3. A User who is a minor shall use the Service with the consent of a parent or other legal representative.

Article 3 (Handling of Images and Other Data)

  1. Loading, editing and exporting images in the Service all take place within the browser on the User's own device. The Operator does not receive, store or view any images or other data handled by the User in the Service.
  2. Image stamps created by a User in the Service may be stored on the User's own device (in the browser's local storage) so that they can be reused later. Such data is never transmitted externally. It may be deleted by the User's browser settings, by clearing browsing data, or in similar circumstances.
  3. Rights in the images and creations handled by a User in the Service belong to that User or to the rightful rights holder. The Operator acquires no rights in them.
  4. Work in progress is lost when the page is closed or reloaded. Users are responsible for exporting and keeping any data they need.
  5. The Service uses a cookie-free analytics service (Cloudflare Web Analytics) to understand usage of the Service. The information collected is statistical in nature, such as pages viewed, referrers, language, and browser used, and does not include any personally identifying information or any image data handled in the Service.

Article 4 (Prohibited Conduct)

When using the Service, Users must not:

  1. act in violation of laws or regulations, or of public order and morals;
  2. infringe the copyright, trademark rights, portrait rights, privacy, or any other rights or interests of a third party;
  3. interfere with the operation of the Service, gain unauthorised access, or engage in similar conduct;
  4. reproduce, modify or redistribute the programs and other components of the Service beyond the scope permitted; or
  5. engage in any other conduct that the Operator deems inappropriate.

Article 5 (Intellectual Property Rights)

  1. Intellectual property rights in the programs, design and everything else that makes up the Service belong to the Operator or to the rightful rights holder.
  2. The Service includes software and fonts provided by third parties, and their use is governed by their respective licences. Licence notices can be viewed from "About" within the Service.

Article 6 (Changes, Suspension and Termination of the Service)

  1. The Operator may change the content of the Service, or suspend or terminate its provision, without prior notice to Users.
  2. The Operator is not liable for any damage caused to Users by the preceding paragraph.

Article 7 (Disclaimer)

  1. The Operator makes no warranty, express or implied, that the Service is fit for any particular purpose of a User, that it has the functionality or accuracy a User expects, or that it will be free of defects.
  2. The Operator is not liable for any damage caused to a User by use of, or inability to use, the Service (including loss of work in progress and loss of data stored on the User's device).

Article 8 (Changes to These Terms)

The Operator may change these Terms without notice to Users where it deems this necessary. The revised Terms take effect when they are posted within the Service.

Article 9 (Governing Language)

The authoritative text of these Terms is the Japanese version. This English version is a reference translation provided for the convenience of Users; in the event of any discrepancy between the Japanese and English versions, the Japanese version prevails.

Article 10 (Contact)

Enquiries about these Terms or the Service are accepted through the contact form within the Service. The Operator may choose not to respond, depending on the content of an enquiry.
